In today’s political climate, immigration has become something many people are afraid to even talk about, let alone search for help with. If this page was found by typing “immigration evaluation Chicago” into Google, that search alone may have taken real courage. Looking for help can feel like a risk when the world feels uncertain, when policies shift without warning, and when simply being visible can feel dangerous.
Gemstone Wellness understands that. Client privacy is something this practice takes seriously, and holds sacredly. Every evaluation is confidential, protected under HIPAA, and shared only with an attorney, or anyone else, with written consent, because trust has to come first for any of this work to matter.
The stress, fear, and anxiety that accompany immigration policies and legal battles are real, and they take a toll on mental health long before a case ever reaches a courtroom. This post explains what immigration evaluations are, what to expect from the process, and how Gemstone Wellness approaches this work with the care it deserves.
What Are Immigration Psychological Evaluations?
An immigration psychological evaluation is a professional mental health assessment that can be used as supporting evidence in immigration cases. It helps document a person’s emotional and psychological impact, giving attorneys and judges a fuller picture of what’s at stake. These evaluations are often needed for cases like:
- Asylum (fleeing persecution or danger)
- U-Visas and T-Visas (for victims of crime or human trafficking seeking legal status)
- VAWA petitions (for survivors of domestic violence)
- Extreme hardship waivers (separation from a family member would cause extreme hardship)
- Cancellation of removal
For many, these evaluations can make the difference between being forced to leave and being able to stay in the U.S. with their loved ones.
Why Mental Health Evaluations Matter
The legal system often focuses on facts, laws, and technicalities, but immigration is personal. A well-documented psychological evaluation gives a voice to the lived experience of those going through this process. It shows the very real impact of deportation, separation, trauma, and fear. It allows judges to see not just a case file but a person.
What to Expect During the Evaluation
Every evaluation follows a similar process, tailored to the details of the case:
- Clinical interview — a detailed, trauma-informed conversation about background, migration history, and psychological symptoms.
- Psychological testing — evidence-based tools to assess trauma, depression, anxiety, and PTSD-related symptoms.
- Clinical formulation — the clinician analyzes the findings to form a clear picture of the person’s psychological functioning and the impact of trauma or hardship.
- Written report — a comprehensive, USCIS- and court-compliant report, written to be clear and free of unnecessary clinical jargon.
- Optional follow-up or testimony — if the case requires it, for an additional fee.
The appointment itself is a single 3-hour session, or it can be split into three 1-hour sessions if that’s easier to manage. A standard evaluation is a flat fee of $1,000, with a slightly higher fee for expedited turnaround, and reports are completed within 21 days. Most insurance plans don’t cover this service, since it’s considered a forensic evaluation rather than treatment.
Clients don’t need an attorney already in place to start. Reaching out directly and being referred by an attorney both happen regularly, and for anyone who doesn’t yet have legal representation, the resources below can help with that step separately.
Every evaluation is confidential and protected under HIPAA. Information is only shared with an attorney, or anyone else, with the client’s written consent.
Held With Cultural Humility and Care
Gemstone Wellness is a women-led, queer-led, Latina-led practice, and that shapes how this work is approached. The immigration and legal systems were not built with equity in mind, and the people navigating them often carry that weight long before they ever speak with an attorney or a clinician. Recognizing that imbalance, and actively working against it, is part of the practice’s approach to every evaluation.
That means meeting each person’s story without judgment, in the language they are most comfortable in, and moving at a pace that respects what they have already survived. It means never treating a client’s history as a checklist to complete, but as a life that deserves to be understood fully and represented accurately. And it means doing everything possible to make an already difficult process feel a little more manageable, one appointment, one conversation, one report at a time.
